Update Your Xbox 360? You Just Agreed Not to Sue Microsoft

e3-2011-xbox-presser1Sony has started a trend that is sure to spread like wildfire through end user license agreements everywhere.

The latest firmware update for the Xbox 360 contains a section in their license agreement where, by mindlessly clicking “I Agree”, you signed up for third party mediation to any of your problems with the software giant rather than suing them In addition you waive your rights to any class action suits. Here is the relevant section:

YOU UNDERSTAND AND ACKNOWLEDGE THAT BY AGREEING TO BINDING ARBITRATION, YOU ARE GIVING UP THE RIGHT TO LITIGATE (OR PARTICIPATE IN AS A PARTY OR CLASS MEMBER) ALL DISPUTES IN COURT BEFORE A JUDGE OR JURY.

Of course this is followed up with a section allowing Microsoft to sue you for using any of their trademarks or intellectual property. Ya know, things like typing the words “Microsoft” or “Xbox 360” without their express written permission.

You can opt out of all this condition by sending physical mail (Yeah, the kind with a stamp) to Microsoft, at the following address:

I can’t wait for this new trend in corporate manhandling to end up in court and be struck down.

  1. I'm not surprised, anything that they can get away with they'll try... Next, you'll be signing away yourself and children into slavery by clicking "I Agree" on shareware.
